Common Law is a legal system wherein a particular case is decided primarily based on the principles of fairness and equity in the absence of a written law. A decided case becomes a "precedent" that will serve as a guide but not necessarily binding on the court in deciding later similar cases. Common Law is the legal system in the United States and the United Kingdom. The other legal system, which is observed elsewhere in the world, is the Civil Law system. In Civil Law, written laws primarily govern human conduct. A case is decided based on the written law. A decided case is binding on the court in deciding later similar cases. Therefore, in the absence of a written law, a party can neither claim relief from nor be sanctioned by the courts.
